AIRLINES' COMMITMENT TO PRIVACY

Porter Airlines Inc. (“Porter” or “we” or “us”) is committed to protecting the privacy of our customers (“You”). This Privacy Policy (“Policy”) describes Porter’s personal information privacy policies and practices with respect to the collection, use and disclosure of Your personal information. Our obligations and Your rights are subject to applicable legislation, including the terms of the Personal Information Protection and Electronics Documents Act.

 

PERSONAL INFORMATION

Personal information is any information about an identifiable individual, such as Your name, email address, mailing addresses, financial information, travel document details, citizenship, gender, date of birth, information collected electronically through Porter’s web site at www.flyporter.com (“Web Site”) and any other information that identifies who You are. Personal information about You may be collected by Porter directly or provided to Porter by third parties, such as travel agents or a credit card company.

 

WHAT PERSONAL INFORMATION DOES PORTER COLLECT ?

Porter limits the collection and use of Your information to the minimum we require to deliver requested information, products or services to You.  We will keep Your information only for as long as it is reasonably needed to fulfill the purposes for which it was collected. We may also collect personal information about You from our service providers.

If You would like to make a reservation or purchase (directly with Porter by telephone, online through the Web Site or through a travel agency or other third party), sign up to a mailing list or program, enter a contest, apply for a job, or request some other information or service that may be offered by Porter from time to time, You will be required to provide certain personal information as is described in this Policy. Requested information may include Your name, address, telephone number, gender, email address, credit card number and expiry date. Requested information is required in order to identify You, in order to contact You, if necessary, and to complete Your purchase or request.

If You request a special service we need to collect additional personal information in order to facilitate Your request:

 

Travel Documents

In order to access airport facilities and permit You to board an aircraft You will be required to provide personal identification documents, (including as may be required by applicable law and airline and airport security requirements) including specified picture identification. Such information is collected for security, legal and identification purposes and is generally returned to You immediately and not retained by Porter.

 

Infants

Porter is pleased to offer free travel to infants under two (2) years of age (without a dedicated seat). In order to confirm the eligibility of Your infant and ensure that Your infant’s ticket is correctly processed we need to record Your infant’s date of birth at the time of booking. At the airport, for verification, You will be required to present identification verifying Your infant’s date of birth. If Your travel includes a transfer from Porter to another airline Your infant’s date of birth may also be transferred to that other airline.

 

Special Services and Assistance and Unaccompanied Minors

Porter is pleased to offer certain special travel services to individuals requiring special assistance. Should You require special assistance, in order to facilitate Your requirements as well as to assure the safety of our passengers and crew, Porter will need to collect and record such information when You make Your flight arrangements (including relevant information such as to whether a wheelchair or oxygen is  required or otherwise concerning Your medical condition, and emergency contact information). Such information will be forwarded to the applicable airport staff, flight crew, connecting airlines and where Porter has outsourced certain operational functions (such as ground handling) to another airline, to such other airline.

If unaccompanied minors are travelling with Porter (in accordance with Porter’s then current unaccompanied minor policy), Porter will require and collect personal information concerning the minor child and their flight itinerary. Porter will also require the name, address and a contact telephone number of: (a) the person(s) meeting the minor child at the destination or point of transfer; (b) the parent or guardian authorizing the travel; and (c) person(s) who should be contacted in the case of an emergency. Such information will be used to facilitate the unaccompanied minors’ travel with Porter and any connecting airlines.

 

Assisting You and Information of Interest

If You book travel through the Web Site, or otherwise subscribe to receive information from Porter,  Your email address will be added to Porter’s email list that will be used to provide You from time to time with information, promotions and offers Porter believes will be of interest to You.  You may at any time notify Porter if You wish to be removed from our email list. All emails sent to You by Porter will include instructions on how to be removed from such email list.

 

Applications For Employment

Porter may from time to time post employment opportunities on the Web Site or otherwise advertise such opportunities. If You would like to apply for such employment opportunities, Porter will ask for and collect Your name, address, email address, telephone number, employment history, education and other information that is relevant and related to Your application and the employment opportunity. Porter will use the information submitted to assess Your application and contact You. Porter may contact applicable third parties to verify any information submitted by You.

 

AGGREGATE INFORMATION

Porter may collect aggregated, anonymous information (such as demographic and profile data, usage and selection data and similar information and data) in connection with Your use of the Web Site and the purchase of Porter services and share that information with other third parties such as Porter’s service providers, agents and advertisers, however, any such aggregated information will not contain personally identifiable information.

 

CONSENT

When You provide Porter with Your personal information to purchase travel or to request information or other services, You are providing Porter your implied consent to collect and use Your information to fulfill the requested service or information.

If travel reservations are made through or by third parties, such as employers, travel agents or others, Porter considers them to be authorized by You to disclose personal information about You to Porter. Such collection, use and disclosure by such other persons will be subject to the privacy policies of such other persons. Porter may be further contacted or contact such other persons to the extent necessary to process and confirm booking changes and otherwise facilitate Your travel arrangements and the provision of other information and services.

Alternatively, You may from time to time, provide Porter with Your express consent to use certain information that is collected at the relevant time for the purposes that are specified at that time (e.g. to participate in surveys or promotional opportunities).

 

CONFIDENTIALITY OF SUPPLIED INFORMATION

In order to protect the security and confidentiality of any personally identifiable information supplied by Porter or retained by Porter (such as booking references related to Your travel with Porter or Web Site passwords) You are responsible to ensure all such information is kept confidential by You

 

RELEASE AND USE OF PERSONAL INFORMATION

Except as is described in this Policy, Porter will not use and will not disclose or provide Your personal information to any person.

In some situations, Porter may use or share facilities, or engage the services of other agencies or airlines to best serve You. For example, particular airport staff may be provided with passenger lists and destinations to ensure proper routing of luggage. Porter will only release information necessary for performing the required service or provision of requested information. Also, Porter's third party service providers may have access to personal information You submit to Porter in order to perform operational or other support services on behalf of Porter (e.g. back office computer services).

Porter is committed to serving its customers in the best way possible; so it is important that we keep You informed about special offers, rates, and other services offered by Porter. We will therefore contact You from time to time through the email address You provide to us to keep You informed of these opportunities.

Porter may disclose Your information to the extent required by law or where Porter reasonably believes it is necessary to do so to comply with law. Also, due to security requirements in Canada and other countries, Porter is required by law to collect, use and disclose to law enforcement and government regulatory and other government authorities passenger information, which may include certain of Your personal information that has been collected by Porter (in some cases such collection, use and disclosure may be made without Your knowledge or consent).  In these circumstances, it is not possible for You to opt-out. Information that may be collected or shared may be more extensive than the information used to book or confirm Your travel.

Porter reserves the right to transfer any information submitted by You and retained by Porter to Porter affiliates to the extent necessary to perform requested services and provide requested information and to any third party purchasers of, or successors to, Porter's business.

 

WEBSITE SECURITY

Porter will use reasonable efforts to protect Your information that You provide to Porter once it has been received by Porter. Porter uses SSL (Secure Socket Layer) technology, an encryption technology used to encrypt information sent over the Internet. Unfortunately, no data transmission over the Internet or system can be guaranteed to be 100%  secure.  As a result, while Porter strives to protect Your personal information, Porter cannot ensure or warrant the security of any information You transmit to Porter, and You do so at Your own risk.

 

LINKS TO OTHER WEBSITES

This Policy applies only to information collected by Porter or supplied by You to Porter. Although the Web Site may provide You with links to other web sites, this Policy does not apply to those web sites or to the other collection, use or disclosure of personal information by other persons.

 

USE OF ‘COOKIES’ AND BEACONS

Porter uses various technologies to passively collect information from You while You are visiting the Web Site (that is You do not actively provide this information to Porter). Such technologies allow the Web Site to collect a range of non-personally identifiable information about Your visit to and use of the Web Site. Porter typically uses such passively collected information for a variety of purposes, such as to administer the Web Site, customize the Web Site to your preferences, and compile aggregated statistics for marketing and research purposes. 2012 Baking in Brief Contest Rules and Regulations

THE PORTER AIRLINES “Baking in Brief” (THE “CONTEST”) IS INTENDED FOR CANADIAN RESIDENTS ONLY (excluding residents of Quebec) AND IS GOVERNED BY CANADIAN LAW. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).

1) Contest Period: The Contest period runs from September 20, 2012 at 11:00 a.m. EST to September 24, 2012, at 5:00 p.m. EST, after which time the Contest will be closed and no further entries shall be accepted.

2) Eligibility: The Contest is open to legal residents of Canada, excluding residents of Quebec, who have reached eighteen (18) years of age or older on or before the start of the Contest Period. In order to claim or use the Prize, a winner (“Winner”) and/or his/her designated guest (“Guest”) may also be required to meet additional requirements, terms and conditions applicable to the use thereof, including but not limited to requirements relating to travel on Porter Airlines and/or attendance at The Baking and Sweets Show (“Event”). Porter Airlines Inc. (“Porter”) will not be liable for any failure by any Winner or Guest to meet such requirements and shall have no obligation to provide any alternative prize components.  Employees and agents of Porter and/or any of its agencies affiliated with the Contest, including prize providers, and the immediate family (spouse, parent, sibling, child) or members of their same households (whether related or not) of any of the above are not eligible to participate in the Contest. Porter shall have the right at any time to require proof of identity, date of birth and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and provided to Porter for the purposes of the Contest must be truthful, complete, accurate and in no way misleading. Porter reserves the right, in its sole discretion, to disqualify any entrant should such an entrant provide untruthful, incomplete, inaccurate or misleading personal details and/or information.

3) To enter the Contest: There is no purchase necessary to enter the Contest. Individuals may enter during the Contest Period using the methods outlined below. No entries will be accepted by any other means.

On the Contest entry form (“Contest Entry Form”), located on the Contest Website, all online entrants must (i) provide their name, email address, mailing address, and mobile phone number; (ii) review and accept these Contest Rules; and (iii) confirm their acknowledgement of and agreement to the Contest release (“Release”) (as described in greater detail in Section 6 below). The contestants must then tweet a recipe to @PorterAirlines from a valid Twitter account to complete the contest entry process.

 

 

Regardless of method of entry, each eligible entry received by Porter during the Contest Period will receive one entry towards the Contest draw. Limit of one (1) entry per person throughout the Contest Period. If it is determined that more than the maximum number of entries is received from any entrant, the entries in excess of the maximum will be discarded. Each selected entrant may be required to provide Porter with proof that such individual fulfills the eligibility requirements. Any disputes as to the qualifying entrant will be decided by Porter in its sole discretion.

Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced. No communication or correspondence will be exchanged with entrants except with the individual(s) selected as winner(s) of the Contest prize(s).

4) Prize: There is one (1) prize (“Prize”) to be won.

The Prize consists of:

a) two Sunday passes to The Event, September 30, 2012

b) two round-trip tickets on Porter Airlines from the Winner’s nearest Porter Airlines airport to Toronto Billy Bishop Toronto City Airport, Toronto, Ontario, departing on September 29, 2012 and returning September 30, 2012. (the “Flight”)

c) hotel accommodation for two people at luxury Toronto hotel, September 29, 2012

d) one Breville ® Stand Mixer

The Winner may designate one Guest to accompany them on the Flight and to the Event, subject to the Guests meeting all eligibility requirements for entry in the Contest and the Guest’s compliance with all other requirements described in these Contest Rules.  The total approximate retail value of the Prize is $3,100. No additional transportation will be provided beyond what is described in the Prize details above.

For the Prize, one entry will be drawn randomly, at 5:00 p.m. EST on July 27, 2012, at Porter’s offices in Toronto, Ontario.


The odds of being selected in the Contest draw depend on the total number of eligible entries received during the Contest Period. Each selected entrant will be notified via phone call by 6:00 p.m. EST on September 24, 2012, and must (i) provide his/her full name and the full name of his/her Guests to a Porter representative along with any proof of eligibility as Porter may require; (ii) correctly answer, unaided, a time-limited mathematical skill testing question; (iii) complete, execute and return a Release (described below in Section 6); and (iv) cause his/her Guests to complete, execute and return an Acknowledgement of his/her agreement to the Contest Rules and a Release, (described below in Section 6) by 12:00 p.m. EST on September 25, 2012, to be declared a Winner, and successfully claim the Prize or the Prize will be deemed forfeited and, at Porter’s discretion, awarded to an alternate Winner. Porter is not responsible for the failure of a selected entrant to receive notification or Porter to receive a selected entrant’s response. If a selected entrant cannot be contacted and/or The Prizes is forfeited, Porter may continue to draw random entries until another Winner is declared. If Porter elects to offer The Prizes to an alternate Winner, the selection and notification of the alternate Winner will be made pursuant to the terms hereof, provided that the drawing for any alternate Winner will be made at a time later than the original drawing.

Provided that the Winner has executed and delivered any applicable tax forms, the Winner and his/her Guest has/have executed and delivered the Prize-specific Release described in Section 6 below, and that the Winner and Guest meet the eligibility requirements of this Contest, The Prizes will be distributed as soon as possible after Winner has been successfully contacted and has fulfilled the requirements set out herein.

The Prizes may not be exchanged for cash, is non-transferable, non-refundable, non-saleable, and must be accepted as awarded, without substitutions. No Winner is entitled to the dollar value of any Prize in lieu of the Prize itself and no Winner is entitled to the monetary difference between the actual Prize value and the stated approximate Prize value, if any. The Prize is awarded “as is” with no warranty or guarantee, either express or implied, by Porter. In the event the Prize, or any portion thereof, cannot be awarded as described in these Contest Rules, Porter has the right, but not the obligation, to substitute a prize of equivalent or greater retail value. Porter will not be responsible if weather conditions or other factors beyond Porter’s reasonable control prevent the Prize or part of The Prizes from being fulfilled. All federal, provincial and municipal taxes and any other costs and expenses associated with acceptance and use of The Prizes that are not specified herein are the sole responsibility of the Winner. The Winner and Guest must be available to attend on the dates and times designated by Porter. Should the Winner and Guest be unable to attend on the dates and times designated by Porter, The Prizes will be forfeited and awarded to an alternate Winner.

5) Operation of the Contest: All entries become the property of Porter which assumes no responsibility for (i) lost, stolen, delayed, damaged or misdirected entries; (ii) entries which fail to comply with the Contest Rules; and/or (iii) any failure of the Contest website (the “Contest Website”) or the Contest Entry Form before the deadline for Contest entry, or for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or failure of any entry to be received by Porter on account of technical problems. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of the Contest Rules and criminal and civil laws, and should such an attempt be made, Porter reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entrants agree to abide by the Contest Rules. Porter reserves the right, in its sole discretion, to terminate the Contest or any Contest-related activities, in whole or in part, and/or modify, amend or suspend the Contest or any Contest-related activities, and/or the Contest Rules in any way, at any time, for any reason, without prior notice. Any changes will be posted on the Contest Website.

6) Releases: Each Winner and Guest will be required to execute and deliver to Porter a legal release in a form prescribed by Porter (“Release”) that confirms, among other things, as applicable: (i) the Winner’s and the Guest’s eligibility for the Contest and compliance with these Contest Rules; (ii) the Winner’s acceptance of the Prize as offered; (iii) the Winner’s and Guest’s release of Porter, and their respective parent, related and affiliated companies and entities, subsidiaries, members, dealers, advertising agencies, franchisees, promotional agencies, prize providers and each of their respective directors, successors, sponsors, partners, licensees, officers, subsidiaries, agents, employees, advisors, assignees, and all others associated with the development and execution of the Contest (collectively, the “Releases”) from any and all liability in connection with this Contest or participation in any Contest related activities; and (iv) the Winner’s and Guest’s grant to Porter, of the unrestricted right, in Porter’s discretion, to produce, reproduce, publish, broadcast, exhibit, distribute and otherwise use or re-use the Winner’s and/or Guest’s, name, photograph, likeness, voice and biography in any and all media now known or hereafter devised in connection with the Contest and the promotion and exploitation thereof. These Contest Rules are additional to and do not supersede the Release and in the event of any conflict between the Release and these Contest Rules, the Release will prevail. In the event of any dispute concerning the operation of any element of the Contest or these Contest Rules, the decision of Porter will be final.

7) Minors: Where Guest(s) is under the age of majority in his/her province of residence, as a pre-condition to the Guest being entitled to participate in the prize, the parent or legal guardian of the Guest must consent in writing to the Guest participating in the Prize and must also sign and return to Porter the release documentation (see Rule 4).

8) Indemnification: By entering this Contest, each entrant acknowledges compliance with, and agrees to be bound by, these Contest Rules and by the decisions of Porter, which are final and binding on all matters pertaining to this Contest. Porter reserves the right to disqualify any entrant who does not abide by these Contest Rules or who tampers with the entry process. Entrants, including Winners and Guests, save, release and hold harmless the Releases from and against any and all manner of action, causes of action, suits, debts, covenants, contracts, claims and demands, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death, or property damage which the entrants or his/her administrators, heirs, successors or assigns might have or could have, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance, use and/or misuse by the entrant of any Prize. In no event will Porter be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of or relating to any entrant’s participation in the Contest, or the acceptance, possession, participation in, use or misuse of any Prize by any entrant or Guest or while traveling to or from any Prize-related activity.

9) Limitation of Liability: Porter assumes no responsibility or liability for lost, late, unintelligible, falsified, damaged, misdirected or incomplete entries, submissions, notifications, responses, replies or any release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur. Porter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. The entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, misuse of or failure to receive any Prize by any Winner or Guest. Porter assumes no responsibility or liability in the event that the Contest cannot be conducted as planned for any reason, including those reasons beyond the control of Porter, such as tampering, unauthorized intervention, technical failures, security, integrity or proper conduct of this Contest, the Contest Website, and/or the Contest Entry Form.

10) Conduct: By participating in the Contest, each entrant agrees to be bound by the Contest Rules, which will be posted on the Contest Website throughout the Contest Period. The entrant agrees to be bound by any decision of Porter in connection with the Contest, which will be final and binding in all respects. Porter reserve the right, in its sole discretion, to disqualify any entrant or Guest found to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry and registration process, and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Winners and Guests must at all times behave appropriately when taking part in the Contest, the Prize and any media obligations and observe the Contest Rules and any other rules or regulations in force online, and/or in any other medium, or in any other locations. Porter reserve the right to remove from any of these locations, any Winner and/or Guest, as applicable, who breaks such rules and/or fails to behave appropriately and to disqualify such Winner and/or Guest. Porter reserve full rights to deny or halt any Winner and/or Guest access to the Prize and/or participation in the Prize if such Winner(s) and/or Guest(s) are rowdy or intoxicated as determined in Porter’s, and/or Event staff’s discretion.

11) Personal Information: By participating in the Contest, each entrant and Guest: (i) grants to Porter the right to use personal information, including his/her name, mailing address, telephone number, voice and/or likeness (“Personal Information”) for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner; (ii) grants to Porter the right to use his/her Personal Information for publicity and promotional purposes, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and (iii) acknowledges that Porter may disclose his/her Personal Information to third-party agents and service providers of Porter, including, but not limited to, its advertising and promotional agencies, in connection with any of the activities listed in (i) and (ii) above. Porter will use the Personal Information only for identified purposes.

12) Media/Publicity relating to the Contest: Each entrant and Guest grants to Porter and VMC the right to use his/her name, address, likeness, biographic or other information concerning the entrant, Winner and/or Guest, as applicable, in connection with the Contest, the selection process and/or any and all promotion in connection therewith without further notice or compensation. In the event the entrant becomes a Winner, such Winner and his/her Guest acknowledge and agree that each shall not, without the written consent of Porter, give any interview or make, give or release any statement for publication, or otherwise to be made public, by any means relating to the Contest or Porter without the prior written consent of Porter.

13) Intellectual Property and Company Information: All intellectual property, including but not limited to, trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by Porter and/or its affiliates. 14) Governing Law: The Contest is subject to all applicable federal, provincial and municipal laws and regulations. The Contest Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Porter. All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Rules or the rights and obligations as between the entrant and Porter in connection with the Contest will be governed by and construed in accordance with the laws of the province of Ontario and laws of Canada applicable herein, including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

15) Language Discrepancy: In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the Contest entry and registration process, the Contest Website, the Contest Entry Form, the Porter website, and/or advertising in any and all media, the terms and conditions of the Contest Rules will prevail, govern and control. In the event of any discrepancy of inconsistency between the English language version and the French language version of the Contest Rules, the English language version will prevail, govern and control.
